This is an English translation of the Czech Terms and Conditions. In the event of any discrepancy between the language versions, the Czech version shall prevail.

3. ORDERING GOODS AND CONCLUDING THE PURCHASE CONTRACT

The list of products on the e-shop website is a catalogue of goods regularly supplied. The Seller does not guarantee the immediate availability of all items displayed. Availability will always be confirmed after verification. The purchase price is determined by the price of the goods displayed on the website at the time the order is placed.

To place an order, the Buyer selects the goods, duly completes the order form and submits the order. The Buyer is obliged to provide a correct and complete delivery and billing address to which the ordered goods are to be sent. Information on the individual technical steps leading to the conclusion of the contract is evident from the ordering process in the e-shop. Before submitting the order, the Buyer can check it and correct it if necessary.

By placing an offer of goods on the website, the Seller expresses its intention to conclude a purchase contract for the goods or services under the stated conditions. The purchase contract is concluded at the moment the Buyer’s binding order is delivered to the Seller. From this moment, mutual rights and obligations arise between the Buyer and the Seller, as defined by the purchase contract and these Terms and Conditions, which form an integral part of the contract.

These Terms and Conditions are displayed on the e-shop website, allowing the Buyer to archive and reproduce them. By submitting an order, the Buyer confirms that they have read these Terms and Conditions and agree to them without reservation. The Buyer is adequately notified of these Terms and Conditions before placing the order.

The contract is concluded in the Czech language unless circumstances on the part of the Seller or the Buyer prevent this; it may also be concluded in another language understood by both parties. The concluded contract (the Buyer’s order) is archived by the Seller for the purpose of its successful performance and is not accessible to third parties. The costs of using means of distance communication (telephone, internet, etc.) to place the order are at the usual rate, depending on the Buyer’s telecommunications tariff, and are borne by the Buyer.

All prices stated in the e-shop are final, i.e. including VAT and all other mandatory fees the consumer must pay to obtain the goods. The Buyer can check the price of each item. Before the order is submitted, the total price of the goods including related fees will be calculated and the Buyer will be asked to approve it. Before placing an order, the Buyer can find out how long the offer or price remains valid. Discounted goods may only be purchased in usual quantities.

Cancelling an order

The Buyer may cancel their order without giving any reason until it has been confirmed by the Seller. In accordance with Section 1829(1) of the Civil Code, the Buyer has the right to withdraw from the purchase contract within thirty (30) days of receiving the goods (see Article 6). The Seller has the right to refuse an order if the Buyer repeatedly fails to take delivery of goods and pay the purchase price.

4. DELIVERY OF GOODS

The purchase contract is concluded at the moment the Buyer’s binding order is delivered to the Seller. After receiving the order, the Seller will send the Buyer a confirmation by e-mail marked “Order Confirmation”.

Delivery time

Depending on availability and the Seller’s operational capacity, the ordered goods will be delivered as soon as possible via Zásilkovna (Packeta) or another carrier, but no later than within 30 days of receipt of the order. The goods are deemed delivered upon delivery to the address specified by the Buyer in the order.

Shipping methods

The Seller delivers orders to the specified address via Zásilkovna (Packeta) throughout the Czech Republic and Slovakia. Goods can also be delivered to other countries worldwide via Czech Post (Česká pošta). Shipping costs vary depending on the chosen shipping method and are always shown in the e-shop before the order is submitted. The Buyer chooses the delivery method. Orders can also be collected in person at AB HUB (Jateční 9, Prague 7 – Holešovice) or at another pre-arranged location.

Payment methods

The Buyer may pay for the goods by bank transfer to the Seller’s account, using the variable symbol identifying the payment (we will send you the variable symbol after receiving your order), or by card via the payment gateway.

If an order paid by bank transfer is not paid within 14 days of being placed, the Seller will cancel it.

Receiving the goods

When receiving goods from the carrier, we recommend that customers check whether the parcel is damaged. In the event of mechanical damage to the packaging or the product itself, a Buyer who is not a consumer must draw up a damage report in the presence of the carrier and have it confirmed by the carrier. Based on this report, the Buyer will be granted a reasonable discount or supplied with a new product. The Buyer also has the right to withdraw from the contract. By signing the carrier’s delivery note, a Buyer who is not a consumer agrees to accept the goods and confirms that they arrived without mechanical damage.

In their own interest, consumers should also follow these steps to avoid later problems regarding liability for defects caused during transport. However, if a consumer does not follow this procedure, their right to file a complaint is not affected in any way.

5. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE (COMPLAINTS)

The Seller is liable to the Buyer that the goods are free from defects upon receipt, in particular that they correspond to the agreed description, type and quantity, quality and functionality, are suitable for the purpose for which the Buyer requires them and to which the Seller agreed, and for the purpose for which goods of this kind are usually used.

The consumer is entitled to exercise rights in respect of a defect that appears in the goods within 24 months of receipt. If a defect appears within one year of receipt, the goods are presumed to have been defective at the time of receipt, unless this is excluded by the nature of the goods or the defect.

Normal wear and tear of the goods (or their parts) resulting from use, and defects caused by improper or careless handling, use contrary to the product’s purpose or mechanical damage, are not considered defects. The period for exercising rights arising from defective performance is extended by the time the goods were being repaired.

If the goods are defective, the consumer may request that the defect be remedied by delivery of new goods free of defects or by repair, unless the chosen method is impossible or disproportionately costly compared to the other. The consumer may request a reasonable discount or withdraw from the contract if the Seller has failed to remedy the defect or refused to do so, the defect recurs, the defect constitutes a material breach of contract, or it is evident from the circumstances that the defect will not be remedied within a reasonable time or without considerable inconvenience to the consumer.

At the consumer’s request, the Seller will provide written confirmation of its obligations arising from defective performance (warranty certificate). Where the nature of the goods allows, a proof of purchase containing the same information may be issued instead. If the Seller provides a period longer than the statutory one, it will specify the conditions and scope of the extension in the warranty certificate.

Complaint procedure

If you need to file a complaint, please notify us by e-mail at ahoj@adventaci.cz and we will send you the complaint form. The form is also available for download here.

The complaint form must include all details of the complaint, namely: the Buyer’s name, address, phone number, e-mail, order number, invoice number, a detailed description of the defect and, where applicable, a description of how the defect arose or manifests itself. The returned goods will only be tested for the stated defect. Parcels for which the reason for sending is unclear will be returned to the sender.

When a complaint is filed, the Seller will issue the consumer with a written confirmation stating the date the complaint was filed, its content and the method of handling requested by the consumer.

We recommend sending the goods in their original packaging or other suitable transport packaging, as the Seller is not liable for any mechanical damage before the goods are received. In the case of a justified complaint, the Buyer is entitled to reimbursement of reasonably incurred costs of filing the complaint (the Buyer must provide proof of shipping). In the case of an unjustified complaint, the Buyer is not entitled to reimbursement of their costs, and the Seller is likewise not entitled to reimbursement of its own costs (unless the consumer has repeatedly filed unfounded complaints, which may be deemed an abuse of consumer rights).

Handling of complaints

The complaint, including remedying the defect, will be handled without undue delay and no later than within 30 days of being filed, unless the Seller and the consumer agree on a longer period. If this period expires without the complaint being handled, the consumer has the right to withdraw from the contract or request a reasonable discount.

The Seller will notify the consumer of the outcome of the complaint by telephone or, if a telephone number is not available, by e-mail. The Seller will issue the consumer with confirmation of the date and method of handling the complaint, including confirmation of any repair and its duration, or a written justification for rejecting the complaint.

6. WITHDRAWAL FROM THE CONTRACT

In accordance with Section 1829(1) of the Civil Code, the Buyer has the right to withdraw from the purchase contract within thirty (30) days of receiving the goods from our e-shop, without giving any reason and without any penalty.

The Buyer may not withdraw from the contract in the case of goods customised according to their wishes (e.g. personalised items) or goods in sealed packaging which the Buyer has unsealed and which cannot be returned for hygiene reasons.

The Seller’s right to withdraw

The Seller may withdraw from the contract only until the goods are dispatched, and only if the goods are unavailable, if discounted goods have been ordered in larger than usual quantities or, where the Buyer is not a consumer, in the event of a significant price change. Before withdrawing, the Seller must always contact the Buyer to agree on further steps.

Procedure for withdrawal

The Buyer may withdraw from the contract by notifying the Seller electronically at ahoj@adventaci.cz, in writing or in another way, no later than on the 30th day after receiving the goods. The Buyer may use the withdrawal form available for download here. Parcels for which the reason for sending is unclear will be returned to the sender.

Upon withdrawal, the purchase contract is cancelled from the outset. The goods must be returned to the Seller within fourteen (14) days of withdrawal. If the Buyer withdraws from the contract, the Buyer bears the costs of returning the goods to the Seller, even if the goods cannot be returned by regular post due to their nature.

Upon withdrawal, the Seller will refund all money received from the Buyer, including the cost of delivering the goods (up to the amount of the cheapest delivery method offered), within fourteen (14) days of the Buyer’s withdrawal, using the same payment method the Seller received it by. The Seller may also refund the payment when the goods are returned or in another way, if the Buyer agrees and incurs no additional costs. The Seller is not obliged to refund the money before the Buyer returns the goods or proves that they have sent them to the Seller.

The Seller is entitled to unilaterally set off any claim for damage to the goods against the Buyer’s claim for a refund of the purchase price.

If a gift is provided to the Buyer together with the goods, the gift agreement between the Seller and the Buyer is concluded subject to a condition subsequent: if the Buyer withdraws from the purchase contract, the gift agreement ceases to be effective and the Buyer must return the gift to the Seller together with the goods.
